Terms of Service

These Terms of Service govern your use of PreClear Health’s remote pre-operative anesthesia clearance service. By engaging us as an operating clinic, or by submitting your intake as a patient, you agree to these terms. They explain what PreClear is, what it is not, how responsibility is allocated under our Shared Liability Framework, and the commercial terms on which we operate.

1. About these terms

These terms form a binding agreement between you and PreClear Health. Where you act on behalf of an operating clinic, you confirm that you have authority to bind that clinic. Where you act as a patient, your agreement is captured in the consent step at the start of your intake.

Capitalised terms used in this document are explained where they first appear. Provisions specific to operating clinics or to patients are flagged. Where a separate addendum applies (for example, a pilot-clinic agreement), the addendum controls in the event of conflict.

2. About PreClear Health

PreClear Health is a remote pre-operative anesthesia clearance service operated by a consultant-anesthesiology team practising at leading private medical institutions in Istanbul. Our deliverable is the PreClear Verified™ advisory report, produced under our documented methodology, The PreClear Protocol™.

PreClear Health is an advisory service. We do not perform anesthesia. We do not perform surgery. We do not authorise admission, induction, or any in-theatre clinical decision. The operating anesthesiologist at your chosen clinic performs the final pre-induction assessment and is responsible for every decision taken in or after the operating theatre.

3. Eligibility

PreClear Health serves adults (eighteen years and over) considering elective procedures, primarily rhinoplasty and other aesthetic, ENT, and bariatric surgery, performed at participating clinics in Turkey. Procedures considered emergent, or where the clinical risk profile materially exceeds the parameters of our methodology, are outside our scope; in such cases our consultant team will decline to issue an advisory opinion and the operating clinic will be informed.

4. The PreClear Protocol™

The PreClear Protocol™ is the end-to-end clinical methodology used by PreClear Health. It is structured into five stages:

  1. Structured patient intake, delivered in the patient’s preferred language with translation provided by our intake agent.
  2. Deterministic risk scoring (ASA suggestion, STOP-BANG, Caprini, and the composite PreClear Score™) computed on the structured data.
  3. Workflow routing — straightforward cases proceed to standard review; flagged cases are routed to senior reviewers, blocked pending additional information, or referred for in-person assessment.
  4. Human review by a consultant anesthesiologist. Every clinical decision is taken and signed by a human. AI assistance is documented in the audit trail and does not produce autonomous clinical decisions.
  5. Issuance of the PreClear Verified™ advisory report, signed institutionally by PreClear Health Clinical Leadership and shared with the operating clinic and the patient.

The protocol, the score, and the report format are intellectual property of PreClear Health. See Section 12.

5. Accounts, authentication, and access codes

Operating clinics receive authenticated access to a dedicated dashboard. Patients do not need an account: their intake is associated with an opaque case identifier, and access to their PreClear Verified™ report is gated by a one-time access code delivered to their registered email.

You are responsible for safeguarding your dashboard credentials and your access code. Sharing credentials, sharing access codes outside the intended recipient, or circumventing our authentication is a breach of these terms. Multi-factor authentication is supported for privileged accounts; where it is enabled for your role, you must complete it at sign-in.

6. Patient responsibilities

As a patient using PreClear, you commit to answer our intake questions accurately and completely, to upload the requested photographs and documents in the form requested, and to inform us promptly of any change in your health status between submission and surgery. Failure to disclose material information may invalidate the advisory opinion and expose you to clinical risk on the day of surgery.

7. Operating clinic responsibilities

Operating clinics that integrate PreClear Health commit to:

  • Provide accurate information about the planned procedure, the operating anesthesiologist, and any clinic-specific protocols.
  • Perform the final pre-induction assessment of the patient on the morning of surgery in line with applicable Turkish anesthesiology guidelines and the operating clinic’s own internal standards.
  • Treat the PreClear Verified™ report as one structured input into the final clinical decision, not as a substitute for that decision.
  • Honour any conditional recommendations issued by the PreClear consultant team (for example, in-person airway assessment, additional pre-operative testing, or referral).
  • Maintain their own clinical and medico-legal records in line with the Turkish Remote Health Services Regulation and KVKK record-keeping requirements.

8. Fees and billing

PreClear Health’s commercial relationship is with the operating clinic, not directly with the patient unless explicitly agreed. Fees are quoted in EUR and are payable in advance per the pricing schedule communicated to you and recorded in our records.

Pilot-cohort clinics may be subject to a separate “Founding Clinic Agreement” addendum, which can include discounted pricing, priority turnaround, and additional service-level commitments.

Payments are processed by Stripe under their applicable terms. PreClear Health does not store full payment-card details.

9. Cancellations and refunds

A pre-operative clearance assignment can be cancelled by the operating clinic at any time before the assigned consultant begins review. Refund policy and any non-refundable portion are described in the Founding Clinic Agreement or the applicable order form.

Where PreClear Health declines to issue an advisory opinion (for example, the patient is outside our service scope), the operating clinic is informed promptly and any fees collected for that specific case are refunded.

10. Shared Liability Framework

PreClear Health operates under a documented Shared Liability Framework. Liability for the patient’s perioperative outcome is shared and distributed between PreClear Health, the operating clinic, and the patient according to the role each party plays in the pre-operative chain. Liability is not transferred from any party to another by use of this service.

  • PreClear Health is responsible for the accuracy and completeness of the advisory opinion issued under The PreClear Protocol™, given the information available at the time of review.
  • The operating clinic remains responsible for the final pre-induction assessment of the patient and for every clinical decision taken from induction onwards.
  • The patient is responsible for the accuracy and completeness of the information they submit, and for disclosing any change in their health status between submission and surgery.

Detailed allocation of liability between PreClear Health and each operating clinic is captured in the Clinical Services Agreement signed with that clinic before any patient is processed.

11. Intellectual property

The PreClear Protocol™, the PreClear Score™, the PreClear Verified™ report format, and the PreClear Health brand are intellectual property of PreClear Health. Operating clinics receive a limited, revocable, non-exclusive licence to use these marks solely to identify the clearance source on their patient records and pre-operative documentation.

Patient information submitted through our intake remains the patient’s personal data; we process it on the legal bases described in our Privacy Policy. Aggregated, de-identified analytics derived from intake content may be used by PreClear Health to improve the service and the protocol.

12. Disclaimers

PreClear Health’s service is provided on an advisory basis. We do not warrant any specific clinical outcome. The remote nature of pre-operative assessment carries inherent limitations: in particular, photo-based airway examinations cannot substitute for an in-person Mallampati examination, and structured questionnaires cannot detect all forms of patient under-reporting. Where uncertainty is material, our consultant team will recommend in-person assessment.

Nothing in our service, the report, or any communication should be interpreted as guaranteed, absolute, or risk-free. The Turkish Remote Health Services Regulation governs the scope and limits of telemedicine consultations; our service is operated in alignment with that regulation.

13. Limitation of liability

To the maximum extent permitted by applicable Turkish law, PreClear Health’s aggregate liability for any claim arising out of the provision of the service is limited as agreed in the Clinical Services Agreement with the operating clinic. Nothing in these terms excludes or limits any liability that cannot be lawfully excluded or limited — for example, liability for gross negligence or wilful misconduct.

14. Termination

PreClear Health may suspend or terminate access to the service if these terms or the Clinical Services Agreement are materially breached, if continued provision would expose patients to clinical risk, or if a regulator or supervisory authority requires us to do so. Operating clinics may terminate their engagement at any time on the notice period set out in the applicable agreement.

15. Governing law and dispute resolution

These terms are governed by the law of the Republic of Turkey. Any dispute arising from or in connection with these terms is subject to the exclusive jurisdiction of the courts of Istanbul. Patients located in the European Union retain any consumer-protection rights they hold under the mandatory rules of their country of habitual residence.

16. Changes to these terms

PreClear Health may amend these terms from time to time. Material changes are notified by email to the operating clinic’s named contact and announced on this page at least thirty (30) days before they take effect. Continued use of the service after the change effective date constitutes acceptance.
